EUTM regulation: changes applying from 1 October

On 23 March 2016, Regulation (EU) No 2015/2424 of the European Parliament and the Council amending the Community trade mark regulation  entered into force. Among other things, the Amending Regulation changed: the name of the Office to the European Union Intellectual Property Office; the name of the trade mark administered by the Office to the European Union trade mark; and the fee system for trade marks.

The Regulation (subsequently codified as Regulation (EU) No 2017/1001) contains a number of provisions that will apply as and from 1 October 2017 along with new secondary legislation – the Implementing Regulation and the Delegated Regulation. The main areas of change include: the abolition of the graphical representation requirement; the introduction of the EU certification mark; and a number of procedural changes that aim to streamline proceedings and increase legal certainty. The EUIPO Guidelines will be fully updated to reflect all changes applying from 1 October.
