PATENTS

The Enlarged Board of Appeal (EBA) referral from T1807/15 concerns the legality of oral proceedings conducted via Video Conferencing (ViCo) without the consent of all parties. There was some doubt as to whether the referral would actually go ahead, given that the party requesting the referral had already withdrawn their request. The Board of Appeal interlocutory decision in T1807/15 reveals that the Board of Appeal has determined to continue with the referral. Rose Hughes reported on the referral here.

Readers may be aware that, together with Giulia Gasparin, Eleonora Rosati is currently involved in Fashion Law London, an initiative that was born in 2019 to create opportunities of study and discussion, mostly from an IP and IT law perspective, for all those interested in this emerging field of practice and research. As part of this, on Tuesday, 13 April 2021, Fashion Law London will hold an online live event, titled ‘The New Age of Fashion: Sustainanle Horizons’, to discuss everything sustainability in fashion. Eleonora Rosati provided all the details of the event here.

 

Eleonora Rosati has developed IP and study aid materials primarily aimed at her students. Among them, there was a table summarising the treatment of linking after the seminal CJEU decision in GS Media. Eleonora Rosati has now updated that table so to include the findings in VG Bild-Kunst.
