Advantek Marketing, Inc. v. Shanghai Walk-Long Tools Co., Ltd., 17-1314
Reinstated a patent infringement claim relating to a design for a portable animal kennel. The patent owner insisted it should not be estopped by prosecution history from asserting its infringement claim against a competitor. Agreeing that estoppel did not apply, the Federal Circuit reversed the district court’s judgment on the pleadings and remanded for further proceedings.
