Two weeks into the new year and our Kats have already discussed a number of different topics.
Neil Wilkof took us back to the medieval ages, and looked at the work of Moses Maimonides’ “The Guide of the Perplexed”. Neil discussed how this medieval philosopher was concerned lest third-parties misused his famous treatise, and ruminated on whether Maimonides was exercising a medieval form of moral rights.
Eleonora Rosati reported on a seminal Italian Supreme Court decision setting out the requirements and limits of parody under both copyright and trade mark law–concerning no less than a bottled water ad featuring the character Zorro!
Marcus Pemsel took us through a recent German Supreme Court decision setting out the standards one must meet to obtain a blocking order against websites that host infringing content, arguing that perhaps, these requirements are set too high.
