In 2019, before the pandemic stopped activities, the German Association for the Protection of Intellectual Property (‘GRUR’) had run, for a repeat time, the reputed ‘GRUR meets Brussels’ conference. GRUR, established in 1891, is a recognized non-profit scientific association of all members of professional groups and organizations active in the field of intellectual property law; these are, particularly, law professors, judges, civil servants, lawyers, patent attorneys and representatives of associations and companies.
Now, in 2023, six years after EU trademark law was amended after thorough evaluation, GRUR is excited to be back in town, discussing remaining drawbacks, such as the so-called ‘Alicante torpedo’ or the – still lacking – unification of sanctions.
The afternoon of 13 June 2023 will see a thorough and critical discussion of the European Commission’s most recent two proposals to modernise the legislation on design protection, consisting of a ‘Proposal for a Regulation amending the Community Designs Regulation [COM(2022)666]’ and a “Proposal for a Directive on the legal protection of designs [COM(2022)667]” and a ‘Proposal for a Directive on the legal protection of designs [COM(2022)667]’. The session will proceed from what the GRUR’s Committee for Design Law submitted elsewhere in January 2023 but also consider feedback from other stakeholders. The ‘GRUR meets Brussels’ Workshop 2023 provides for a perfect opportunity to discuss the two proposals and related comments/concerns, including the removal of the current seven-view limitation, possibilities to amend the representation of the EU design before registration and the issue of disclosure in case of unregistered EU designs. Another issue of special interest to be covered will be the so-called repair clause.
